EU extends Ukrainian temporary protection through 2028 with new military status rules

Decision of the European Union Council extending temporary protection for Ukrainians who fled following Russia's full-scale invasion was published in the Official Journal of the EU on Aug. 5, with updated criteria for some categories.
The document specifies that temporary protection for Ukrainians has been extended for another year—until March 4, 2028. The decision took effect today, Aug. 5, 2026.
The document also clarifies the conditions for granting temporary protection to first-time applicants. Specifically, individuals who cannot verify compliance with military service obligations in accordance with Ukrainian law will be ineligible.
The decision noted that this requirement is introduced taking into account Ukraine's current defense needs. To verify compliance with military duties, EU member states may require relevant documentation or alternative proof, according to the document.
The new rules apply exclusively to applications submitted after the decision entered into force. However, they will not apply retroactively to Ukrainians who already hold temporary protection status in an EU member state and maintain continuous status.
"Temporary protection should be granted only to individuals who can provide competent authorities of the member state with evidence that they are, where applicable, fulfilling their military obligations," the Council of the European Union decision states.
On July 15, EU member states agreed to extend the temporary protection mechanism for displaced Ukrainians until March 4, 2028.
On July 30, the Council of the European Union formally approved the temporary protection extension for Ukrainians via written procedure, modifying conditions for individuals subject to military service.
