The business community recalled that on April 30, 2025, Ukraine and the United States signed an agreement on the creation of the American-Ukrainian Reconstruction Investment Fund, which was later ratified by Ukraine’s parliament.
It was later announced that the U.S. International Development Finance Corporation (DFC) and Ukraine’s PPP Agency had signed two additional agreements:
— a Limited Partnership Agreement;
— a Limited Liability Company Agreement.
The partnership was described as a mechanism aimed at stimulating investment in sectors critical to Ukraine’s reconstruction. At the same time, provisions of the Limited Partnership Agreement reportedly introduce separate conditions for issuing subsoil use licenses, including requirements related to procurement agreements for extracted resources.
The business community stressed that such provisions could directly affect the operations of subsoil users, the competitive environment and the investment attractiveness of Ukraine’s extractive industry.
However, Ukraine’s PPP Agency classified documents related to the agreements as official-use information.
The association noted that Ukraine’s law on access to public information requires disclosure of non-restricted portions of information even if some data is classified. It also stressed that restrictions marked “For Official Use Only” can be applied only on grounds defined by law.
“Business considers the contents of the agreements to be socially significant information, as they determine the conditions for economic activity and investment prospects in Ukraine’s extractive industry, and asks that this data be disclosed,” the European Business Association said in a statement.
The corresponding letter was sent to Economy Minister Oleksii Sobolev and PPP Agency Director Niko Gachechiladze.
Earlier, reports emerged on how many applications for financing the American-Ukrainian Reconstruction Investment Fund had received in the year since the agreement establishing it was signed.
