EU to withdraw protection from arriving draft-age Ukrainians within weeks

The plans also include extending legal protections for refugees already in the EU through March 4, 2028. The source said further consideration now lies with EU member states, which are likely to move quickly. After political agreement, it usually takes about 20 days until the decision is formally published and comes into force.
The European Commission rejected claims that the changes are discriminatory, saying the measure does not mention draft-age male applicants explicitly.
“The text of the decision is not formulated as one that concerns men,” Brussels said.
“It is drafted neutrally and concerns persons who are subject to military duties under Ukrainian law.”
The official added that Ukrainians who do not meet the new temporary protection conditions can still apply for asylum, but that process involves individual assessment and does not guarantee a positive outcome. He said draft evasion alone is not grounds for asylum and chances of success for such claims are considered low.
The commission emphasized that the restrictions will not apply to Ukrainians who already have temporary protection in EU countries: their protection will be extended, including for those who are subject to mandatory service. Exceptions may apply for some people with military obligations who already hold that status.
“We are already discussing this issue with the Ukrainian authorities to ensure the most objective and fair verification mechanism possible,” the official said.
“If a person was allowed to leave, for example, for a
one-week business trip but seeks temporary protection, by making that
application they would effectively be violating the legality of their departure
from Ukraine.”
