SAPO seeks court ruling to suspend Pavlo Kyrylenko as Antimonopoly Committee chairman

The Specialized Anti-Corruption Prosecutor's Office has filed a motion to suspend Ukraine’s Antimonopoly Committee head Pavlo Kyrylenko from office, the AMCU press service said on Aug. 8.

According to the Specialized Anti-Corruption Prosecutor’s Office (SAPO), after the indictment against Kyrylenko was submitted to the court, his defense attempted to have the High Anti-Corruption Court judge removed from the case.

The prosecution stated that the official’s lawyer, in the motion for recusal, argued that the judge might issue a decision — potentially unfavorable — regarding a company where a relative of the judge is employed. Kyrylenko himself supported this motion.

The SAPO prosecutor petitioned the court, as the head of the Antimonopoly Committee of Ukraine (AMCU) had admitted that he could potentially use his position to influence parties involved in the case through their relatives, as well as obstruct the criminal proceedings in other ways.

Kyrylenko case

On Aug. 14, 2024, Pavlo Kyrylenko was officially notified of suspicion. According to NABU, between 2020 and 2023, while serving as head of the Donetsk Regional Administration, Kyrylenko purchased 21 real estate properties and a luxury vehicle, registering the assets under his wife’s relatives.

The difference between the value of the assets and the legal income of Kyrylenko and his wife amounted to UAH 56.2 million. In addition, according to NABU, Kyrylenko failed to declare this property in his asset declarations for 2020, 2021, 2022, and 2023.

NABU and SAPO registered criminal proceedings against Kyrylenko under Article 368-5 of the Criminal Code (illicit enrichment) and Article 366-2 (declaring false information) back in March 2024, following an investigation by Schemes.

On Aug. 28, the High Anti-Corruption Court rejected NABU and SAPO’s motion to detain Kyrylenko and instead imposed a preventive measure in the form of bail set at UAH 30 million.

On Aug. 29, bail in the amount of UAH 30.28 million was posted for Kyrylenko. On Sept. 16, the High Anti-Corruption Court denied prosecutors’ motion to place Pavlo Kyrylenko in custody.

On Dec. 9, NABU and SAPO announced the completion of the investigation against Kyrylenko.
